Abstract
:
The current study dealt with research in the criminal protection of electronic commerce, In the Saudi. The importance of the topic stems from the current developments and the almost total dependence on the electronic commerce. In this study the concept of electronic crime in the Saudi system and in the comparative laws was addressed. Furthermore, the study discussed the legal framework for electronic crime, the legal framework for electronic crime and the objective criminal protection for the trader in electronic commerce and criminal protection for the consumer. The study then provided an explanation to how to use the electronic means in that and the systems that provide protection for this trade. Finally, the study dealt with the procedural protection for electronic commerce and the types of procedural protection, then it elaborated on the pre-trial stage, which includes the stage of research, investigation, and inspection. Then during the trial phase, which included the competent court and the authority of the criminal judge in assessing electronic evidence and getting acquainted with the subject from all sides. The study provided some recommendations including: 1- To escalate the level of formation of agencies specialized in dealing with information crimes, 2- To explicitly stipulate international judicial cooperation in the field of combating e-commerce crimes of all kinds and forms.
